Stephen Chastain
Lineage
Stephen Chastain (est 1690-1751) is one of the "unplaced"
Chastains. Per Otter pg 27: "came about the same time as Peter Chastain in
1700. He is thought to have been perhaps distantly related to Peter Chastain
at the best he came from southern France. Although the records of King
William Parish record births of sons, they are thought not to have lived to
maturity as in his will in 1740, Stephen does not name any sons, nor does
his wife who died shortly thereafter." Following are pieces of information gleaned about this man. Note that the Family Tree info is not verified, just added as a potential source. |

-The Douglas Register only mentions Stephen.
-Jean Calvert of the Craven Precinct of North
Carolina appointed Stephen Chastain, his good
friend, as his lawful attorney, to represent
him. He must have had a law degree to allow a
judge to act as an attorney.
-Records show William Byrd II went to France to
study law. He was a good friend of Stephen
Chastain who bought land from him - coal mine
land.

-The will of Martha Chastain names beloved
daughter, Mary Magdelane of this plantation I
now dwell upon, all my other land devised me by
my husband, Stephen Chastain containing
314
acres. Also her part of all Negroes devised to
her by y husband with all the moveable and
unmovable property. If Magdalaine should die
underage or unmarried, having no issue, the
above said land and movables to be equally
divided between my brothers, Peter Dupuy, John
James Dupuy and John Levilain, Jr. If Mary
Magdelaine should be married but die under age,
the land and Negroes to brothers Peter Dupuyh,
John James Dupuy and John Levilain; with
movables to her husband. I give to my brother
Peter Dupuy and John Levilian, m brother-in-law,
all my part of money that is in the house and
all m part of money that is due to me by Edward
and William Hampton and Mathew Agee to be
equally divided between them for their heirs
forever, after 5 pounds taken ot of the above
mentioned mony to satify Barbara Dutoys_________
and 4 pounds to John Farcy to give the remainder
to Peter Dupuy and John Leviain, Jr. forever.
I give to Barbara Dutoy 2 pounds current money
for her heirs forever. I give John Fary, son of
Stephen Farcy, 4 pounds current money for him
and his heirs forever. I give to the poor of
KWP 2 pounds 10 shillings to be paid in wheat
and corn. The wheat at 3 shlins per bushel and
the corn at 6 pence per bushel. There were
several other items in the will including land
Stephen bough of Jacob Copoon of
46 acres to
John James Dupuy, her part in a bayhrse branded
on the rear buttock EC and called by the name of
Robins. Also "my part in the bed and furniture,
a new trunk last bought and what is in it. A
large cupboard and what is in it. 2 black
walnut tables, a ___iron and pair of hand irons,
one brass bottle, a side saddle and all my
wearing apparel not to be appraised. One
_________tread not to be appraised. Brother
John James Dupuy to be executor and adm. Signed
by her mark for Martha Chastain, 23 Apr 1740.

On 10 Jun 1714 Stephen Chastiane (spelled Chastiene and Chasteane) was granted 280 acres, and on 16 Jun 1714 he patented 138 acres (Virginia Patent Bk. 10, pp. 295, 298). On 17 Aug 1720 another 37 acres was granted him (spelled Chasteain) (ibid., 11:46), and on 5 Sep 1723, 200 acres and 219 acres "joining to the land where he now lives" (ibid., 11:247, 248). Summary Contains a petition of Stephen Chastain to Lieutenant Governor William Gooch asking that no patent may issue on a survey for 274 acres of land lying on the southside of Jones’ Creek in Henrico County. According to the petition, this land was surveyed by John Woodson in 1726 for Anthony Rapean. - These colonial papers are a collection of loose papers more closely connected by age than by any other single factor that consist largely of records kept by the clerk of the colonial council, House of Burgesses, the governor and other officials, relating to county as well as colony-wide government. The records of the colonial government have, for the most part, been destroyed by wars, fires, and early neglect. This collection of loose colonial papers is arranged in chronological order, in fifty-three folders. The collection consists of petitions to the governor or House of Burgesses, court records, orders, summonses, patents, accounts, proceedings, returns, grants, proclamations, addresses, certificates and correspondence. Source LVA - Summary Location: Goochland County. Description: 400 acres between the two Manacan Creeks on the south side of James River. Source: Land Office Patents No. 13, 1725-1730 (v.1 & 2 p.1-540), p. 494 (Reel 12). Part of the index to the recorded copies of patents for land issued by the Secretary of the Colony serving as the colonial Land Office. The collection is housed in the Archives at the Library of Virginia. NOTE: The book "The French Lands", by Priscilla Harris Cabell, p. 117, states: "Registered as 'Pre. Dutoit,' Peter, his wife and two daughters were living in Manakintown in 1714. As he and his wife were Historic Founders, he had, of course, been in King William Parish since 1700. Peter Dutoy (sic) had two patents. The earlier one for 400 acres in 1714 was on 'a Great Branch' of Manakin Town Creek. This branch was named for Peter and became known as 'Dutoy's Branch.' Today, it is called 'Dutoy's Creek.' This patent did not cover French land. It was surveyed by Richard Ligon on 10 February 1706 for Peter Ditnay eight years before he patented it. His second patent, which was part of the first 5,000 acres donated to the French refugees, was less than half a mile down river from the mouth of Upper Manakin Creek.
